Did you paint that wall? If you didn’t, it’s not really your work…
That said, I quite like it as a deck…

Thom – It’s in the photo contest, not the regular one. I’m not making any claims other than my hope that other people like it as a deck. :-)

Though it’s a photo contest I don’t think people should be taking pictures of someone else’s art. I doubt that PopDeck would take on the legal risks of selling it since they don’t have the artist’s permission.

Do you really think there is a copyright issue? I could understand if I took a picture of a fast food chain logo and wanted to put it on a deck, but not graffiti.

You’d have to look into intellectual property etc, not too sure.
Artistically speaking though it brings up some ethical dilemmas. It’s not like you’ve taken a photo of the Mona Lisa, but graffiti artists are still artists, and it’s still their work.

I believe it fits in the realm of Public Domain which is what the rules of the contest require. How is the art of graffiti different than taking a picture of say a door which was hand carved? hehe It’s art too, again, I believe it’s Public Domain. :-)

That said, I doubt I’d use Shepard’s work by using an OBEY sticker. It’s a judgement call. If the owners of Popdeck have a problem, they are free to remove the art. However, I hope they agree with my thoughts.
